These terms and conditions (the "Terms") govern the sale, collection, and delivery of all gourmet sandwiches, platters, sides, and beverages (the "Products") ordered via the Sub Side website, mobile application, or telephone.
By placing an order with Sub Side, you ("the Customer", "you") agree to be legally bound by these Terms.
1. Company Information & Jurisdiction
1.1. Sub Side is registered and operates in Northern Ireland. Our principal place of business is located at: Newtownabbey, Co Antrim.
1.2. These Terms are governed exclusively by the laws of Northern Ireland. Any disputes, claims, or legal proceedings arising out of or in connection with an order will be subject to the exclusive jurisdiction of the courts of Northern Ireland.
2. Order Placement and Contract Formation
2.1. The Contract: When you place an order online or via phone, it constitutes an offer to purchase our Products. A binding legal contract is only formed when Sub Side sends you an official email or text confirmation accepting your order, or when our kitchen begins preparing your food.
2.2. Order Review: Please review your order details carefully before submission. Sub Side is not responsible for errors made by the customer during the checkout process (e.g., incorrect ingredient modifications or delivery addresses).
3. Perishable Goods and Cancellation Policies
3.1. No Statutory Right to Cancel: Under Regulation 28 of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the standard 14-day statutory cooling-off/cancellation right does not apply to the supply of goods that are liable to deteriorate or expire rapidly. 3.2. Because Sub Side products are freshly made to order and highly perishable:

Immediate Orders: Once an order is accepted for immediate preparation, it cannot be cancelled, changed, or refunded.

Pre-scheduled / Bulk Orders: If you have scheduled an order in advance (e.g., corporate catering), cancellations or modifications must be made at least 48 hours prior to the requested slot. Cancellations within this window will be charged in full.
4. Allergens, Food Safety, and Product Variations
4.1. Allergen Information: In compliance with the Food Information Regulations (Northern Ireland), Sub Side provides full allergen tracking on our menu boards and online platforms.
Critical Food Safety Notice: If you have a severe food allergy, you must explicitly declare it in the order notes or call Sub Side directly before ordering. While Sub Side enforces strict cross-contamination protocols, our kitchen handles allergens including nuts, gluten, sesame, and dairy. We cannot guarantee an environment 100% free of allergens.
4.2. Product Variation: Because Sub Side products are handmade, minor variations in appearance, size, or layering may occur.
4.3. Substitutions: In the rare event that a high-quality ingredient is unavailable, Sub Side reserves the right to substitute it with an ingredient of equal or superior quality without prior notice.
5. Prices and Payment
5.1. Pricing: All prices displayed on the Sub Side menu include UK Value Added Tax (VAT) where applicable, but exclude delivery charges. Delivery fees are calculated and clearly shown at checkout.
5.2. Payment: Payment must be made in full at the point of ordering using our approved secure digital payment systems. Sub Side does not accept cash on delivery for online orders.
6. Delivery and Collection
6.1. Delivery Zones: Sub Side delivers to specific postcodes within the Belfast metropolitan area. If your delivery address falls outside our operating zone, Sub Side reserves the right to cancel your order and issue a full refund.
6.2. Estimated Times: Any delivery or collection times provided are estimates only. While Sub Side works hard to ensure your order arrives fresh and on time, delays caused by Belfast traffic, weather, or peak periods do not entitle the customer to a discount or refund.
6.3. Failed Delivery (Customer At Fault): If our Sub Side courier arrives at your specified address and cannot gain entry or contact you via phone within 10 minutes, the driver will depart. Because the food is perishable, the order will be disposed of, and you will be charged the full amount.
6.4. Storage & Handling: Risk of damage or food deterioration passes to you upon delivery or collection. To maintain food safety in accordance with the Food Safety (Northern Ireland) Order, Sub Side products must be consumed immediately or stored in a refrigerator below 5°C.
7. Quality Standards, Refunds, and Complaints
7.1. Our Guarantee: Sub Side warrants that all products are prepared with satisfactory quality, fit for consumption, and match their description at the point of handover.
7.2. Reporting an Issue: If your Sub Side order is missing items, incorrect, or structurally damaged, you must contact us via phone or email within 4 hours of receipt. Due to the perishable nature of our food, we cannot investigate issues raised after this timeframe.
7.3. Resolution: Where an error or quality issue is verified by Sub Side, we will offer an appropriate remedy, which may include a redelivery, store credit, or a partial/full refund to your original payment method.
8. Limitation of Liability
8.1. Nothing in these Terms limits or excludes Sub Side’s liability for death or personal injury caused by our negligence, or for fraudulent misrepresentation.
8.2. Subject to clause 8.1, Sub Side will not be held liable for any indirect losses, loss of business profit, or damages that were not reasonably foreseeable to both parties at the time the order was confirmed. Sub Side's total liability under any circumstances shall not exceed the total price paid by you for that specific order.
